Premium rates
| Type | Pay |
|---|---|
| Overtime (beyond 8 hours a day or 40 a week) | 150% |
| Night work (10 pm – 6 am) | +50% on top |
| Holiday work, up to 8 hours | 150% |
| Holiday work, over 8 hours | 200% |
Premiums stack. Overtime done at night is paid 150% + 50% = 200%. Workplaces with fewer than 5 employees are exempt from these premiums, though you must still be paid for every hour worked.
The 52-hour week
The maximum working week is 40 regular hours plus 12 overtime hours. Overtime needs your agreement, and premiums are calculated from your ordinary wage, the fixed pay for scheduled hours, divided by 209.
Frequently asked questions
Do E-2 teachers get overtime pay?
If you work beyond the hours in your contract and the total exceeds 40 hours a week, the extra hours are overtime. Many hagwon contracts set a teaching-hour rate for extra classes; it must not be lower than the legal minimum.
Is my "inclusive wage" contract legal?
Contracts that pay a fixed overtime amount are allowed only if they pay at least what the law requires for the overtime you actually work. If you work more, the employer owes the difference.
